TERMS OF SERVICE, LIABILITY WAIVER, AND LEGAL NOTICE

By accessing, browsing, or purchasing from spotslap.com ("SpotSlap", "we", "us", or "our"), you ("the Customer", "the User", or "you") expressly agree to the following Terms of Service, Liability Waiver, and Legal Notice. If you do not agree with any part of these terms, you must immediately cease use of this website and refrain from purchasing our products.

1. NATURE OF PRODUCTS AND INTENDED USE

All products sold on spotslap.com, including but not limited to destructible "eggshell" vinyl stickers and decals, are sold strictly as novelty items for entertainment and expressive purposes only.

SpotSlap does not condone, promote, or encourage vandalism, harassment, property damage, trespassing, or any illegal acts. By purchasing these products, you agree that you will only apply them to property that you legally own, or property where you have received explicit, prior written consent from the owner.

2. ASSUMPTION OF RISK

Our products are manufactured using heavy-duty, permanent adhesives and "destructible" vinyl designed to fragment upon attempted removal. The Customer acknowledges and completely understands that:

  • Application of these stickers to certain surfaces (including but not limited to automotive paint, aftermarket tints, tempered glass, mirrors, and plastics) may result in permanent damage.

  • Improper removal attempts (using scrapers, razor blades, abrasive chemicals, or heat) may cause scratching, discoloration, or destruction of the underlying surface.

  • Applying stickers to vehicles or property in a manner that obstructs a driver's view, obscures license plates, or alters safety sensors is dangerous and illegal.

By purchasing and using our products, you assume 100% of the risk associated with their application and removal.

3. ABSOLUTE WAIVER AND LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, SpotSlap, its owners, operators, affiliates, and suppliers shall not be held liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from the use, misuse, or inability to use our products.

You explicitly agree that SpotSlap cannot and will not be held responsible for:

  • Property Damage: Any damage caused to vehicles, windows, paint, clear coats, or any other surface by the application or removal of our stickers.

  • Legal Consequences: Any civil lawsuits, criminal charges, fines, citations, or legal actions brought against you for vandalism, property damage, or trespassing resulting from your use of the products.

  • Physical Altercations: Any personal injury, harm, or distress resulting from confrontations or altercations that occur as a result of applying these stickers to another individual's property.

4. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SpotSlap, its owners, and its affiliates from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

(a) Your use or misuse of the products purchased from spotslap.com;

(b) Your violation of any local, provincial, state, or federal laws;

(c) Your violation of the rights of any third party, including property rights;

(d) Any claim that your use of the product caused damage to a third party.

5. RIGHT TO REFUSE SERVICE

SpotSlap reserves the right to refuse service, cancel orders, or terminate accounts at our sole discretion, without prior notice, if we suspect that our products are being purchased with the intent to commit a crime, engage in targeted harassment, or violate any applicable laws.

6. INTELLECTUAL PROPERTY

All content on spotslap.com, including but not limited to sticker designs, graphics, text, logos, and website layout, is the intellectual property of SpotSlap and is protected by copyright and trademark laws. Unauthorized reproduction, resale, or distribution of our designs or products is strictly prohibited and will result in legal action.

7. GOVERNING LAW AND JURISDICTION

These Terms of Service and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located within Ontario, Canada.

8. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
